The TracFone data breach class action (Barcomb v. TracFone)
The case followed a data security incident in December 2021. It was filed as Barcomb et al. v. TracFone Wireless, Inc., case 1:24-cv-08710 in the U.S. District Court for the Southern District of New York. Plaintiffs alleged TracFone failed to protect customer information. TracFone denied wrongdoing and settled without admitting liability.
The class covered current and former U.S. customers whose information was affected. That included customers of TracFone, Straight Talk, Simple Mobile, Net10, Walmart Family Mobile and Total Wireless.
TracFone lawsuit payout per person
- ▸Ordinary losses and lost time: up to $3,250 per person. Lost time was paid at $30 an hour for up to 15 hours.
- ▸Extraordinary documented losses, such as identity theft: up to $50,000.
- ▸Three years of one-bureau credit monitoring with identity theft insurance.
These were caps, not automatic amounts. What each person received depended on what they claimed and documented.

FCC $16 million settlement (2024)
On July 22, 2024, the FCC announced that TracFone would pay a $16 million civil penalty. This settled an investigation into three data breaches involving TracFone's customer-facing APIs. The consent decree also requires TracFone to improve its API security, protect against SIM swaps and port-out fraud, and train employees on privacy. This was a government penalty, so customers did not receive payments.
FTC $40 million "unlimited" data settlement (2015)
In January 2015, TracFone agreed to pay $40 million to settle FTC charges that it throttled or cut off data on "unlimited" plans sold under Straight Talk, Net10, Simple Mobile and Telcel America. The money went to refunds for affected customers, and that claim process ended long ago.
Is there an open TracFone class action now?
We are not aware of an open TracFone class action taking claims as of October 2026. Be careful with sites asking for your account PIN or Social Security number to "join" a TracFone lawsuit. Legitimate settlement administrators never ask for your account PIN. Also note that TracFone's terms require most disputes to go to individual arbitration, which limits new class actions.
